Updated Hazardous Policy Clarification Regarding Classes 2.1 and 3

 

There will be a change to the TMAK hazardous policy to ensure compliance with applicable 49 CFR regulations.

  • Policy Change: Effective February 19, 2019, TOTE Maritime Alaska will not accept classes 2.1 and 3 in limited quantities in running or non-running refrigerated equipment.
  • Reason For Change: The refrigeration unit is considered an ignition source that could ignite an explosive atmosphere. Allowing classes 2.1 and 3 to ship in a running reefer is not compliant with the 49 CFR regulations, 173.305(d)(4).
  • Impact:  This change expands the current policy scope to include classes 2.1 and 3 that are declared as Limited Quantities. TOTE will still accept classes 2.1 and 3 in Limited quantities in insulated and dry equipment only. This practice was reviewed by the US Coast Guard resulting in the recommendation and subsequent policy change.

Approved Equipment with Modifications – refrigerated containers, that are shipper owned equipment, that have removed the genset and have stenciled “DO NOT PLUG IN ON VESSEL” will be allowed. These trailers may not be booked with KFF service. At the time of submitting the hazardous declaration, please specify in writing that the refrigerated equipment is a modified container with the genset removed and that the trailer is stenciled with “DO NOT PLUG IN ON VESSEL.”

A refrigeration unit is considered an ignition source that could ignite an explosive atmosphere. Allowing classes 2.1 and 3 to ship in running reefers is not compliant with the 49 CFR regulations, 176.200(f). Insulated trailers are not considered an ignition source because the equipment does not have a heating/cooling unit and uses heat tape to prevent freezing which does not present the same ignition hazard.
